This privacy notice describes how Studio BlueGreen will collect and use the personal information that you provide to us when you use this site, including when you sign up to receive our updates or contact us to get involved. It also applies to a limited number of other circumstances where we collect and use your personal information, for instance, when you apply for a job with us or make an application for funding. These are described in more detail in section 3.

It is important that you read this privacy notice together with any other privacy notice that we have provided or may provide to you when we are collecting or processing personal information about you in other contexts, for instance when we enter into funding agreements with you. This privacy notice supplements any other such notices.

In this notice, references to “we” or “us” are to Studio BlueGreen and references to the GDPR are to the General Data Protection Regulation (EU 2016/679).

Studio BlueGreen is a charitable company (Charity No. 1163124, Company No. 09646831) and is the controller in respect of personal information processed about you, as described in this privacy notice.

We will collect personal information about you:

3.1 when you contact us directly to make an enquiry (including to request information) or to make a complaint;

3.2 when you subscribe to our newsletter or] sign up to receive other communications or updates from us;

3.3 when you contact us to request funding or other support or to enquire about working in collaboration or partnership with us;

3.4 if you provide personal information to us for any reason in the context of you collaborating with us/ us working together;

3.5 when you instruct third parties such as lawyers to provide us with personal information about you on your behalf;

3.6 when we undertake due diligence about you to assist us to establish and maintain relationships which we believe are in the best interests of Studio BlueGreen;

3.7 when we collect information about you from publicly available sources so that we can research potential funding opportunities and understand developments in the market. This may include, for instance, information about you if you are part of the management or other personnel at an organisation with which we may collaborate or provide financial support; and

3.8 when you apply for a role with Studio BlueGreen.

We may collect, store and otherwise process the following kinds of personal information about you:

When you contact us via the website including to subscribe to receive our newsletter or other communications and/or updates

4.1 your full name and contact details, including email address, postal address, telephone number, place of work;

4.2 details of any correspondence that you send to us;

When you apply for a role with us

4.3 information about you that you include in any job application to us, including (where relevant and without limitation) information about your current or former employers, education, affiliations, and professional experience;

4.4 information about your professional experience and qualifications including references relating to your previous role(s) from former employers;

When we collaborate with your organisation through providing funding or otherwise

4.5 details of your role, position/title and area of responsibility at the organisation you represent – this will be processed if you deal with Studio BlueGreen in your capacity as an officer, employee, director and/or principal of an organisation that we may collaborate with;

4.6 information about your professional experience and qualifications;

When you navigate our website

4.7 Your browsing information including information about your visit to the site such as the pages you visited and clickstream to and from our site.

We will only collect and use sensitive information (also known as special category data under the GDPR) if there is a valid reason for doing so and where the law allows us to. Sensitive information includes personal information about health, ethnicity, religion, political opinions or sexuality. For instance, information about a supporter’s health is sensitive information.

We request that you avoid disclosing to us any sensitive information relating to you or anyone else when providing us with personal information, except where that information has been requested.

When we collect sensitive information or criminal conviction data about you and we are required to tell you what our lawful basis is for doing so, we will set this out.

Studio BlueGreen will use your personal information for a variety of purposes:

We will use your contact details:

(a) to contact you to send you [our newsletter/ updates] where you have subscribed to receive such communications from us online;

(b) to contact you to inform you of events or publications or services we think you may be interested in;

(c) to satisfy legal obligations which are binding on us;

(d) to communicate with you about any funding or collaboration opportunities that you have enquired about.

We will use information that you provide to us in connection with an application for a role with us:

(a) to process your application;

(b) to conduct background checks;

(c) to make a decision about your recruitment or appointment;

(d) to monitor and assess our own recruitment process;

(e) to comply with applicable employment law requirements.

We will use information that you provide to us in connection with an application for funding or other support

(a) to process your application;

(b) to work with organisations which carry out background checks to allow us to make decisions about whether it is appropriate to support the organisation that you represent;

(c) to monitor compliance with grant conditions;

(d) to review the outcomes of funded projects; and

(e) to carry out analysis for auditing and compliance purpose.

Under the GDPR, we are required to rely on one or more lawful grounds to collect and use the personal information that we have outlined above. We consider the grounds listed below to be relevant:

7.1 Legitimate interests

We rely on this basis where applicable law allows us to collect and use personal information for our legitimate interests and the use of your personal information is fair, balanced and does not unduly impact your rights. For instance, it is in our legitimate interest to use personal information provided by you when you contact us to enquire about collaboration to contact you to explore opportunities for collaboration.

7.2 Consent

We may obtain your consent to use your personal information in certain circumstances e.g. to send you email marketing by email or where you have voluntarily provided us with sensitive personal information about you. We will ensure that when we obtain your consent you are free both to give it and to decline to give it. Additionally, you may always withdraw your consent at any time without any further detriment to you.

Studio BlueGreen will not sell, rent or lease the personal information that you provide to us to with third parties. However, we may ask third party processors to assist us and we may disclose your personal information to selected third party processors (such as agents or sub-contractors) for the purposes outlined at section 6. The third party in question will be obligated to use any personal information they receive in accordance with our instructions.

We may also engage third parties to assist us with website hosting, data analysis, transaction processing and other administrative services.

For individuals and/or organisations with which we form grant-making partnerships, we may provide your personal information to non-affiliated organisations that collaborate with us or provide services to us. Examples of this would be: organisations that assist with our grant partner identification programme or help us to prevent fraud or other financial crime. Non-affiliated organisations that assist us in providing services to you are required to maintain the confidentiality of such information and to use it only in the course of providing such services and for the purposes that we specify.

We reserve the right to disclose your personal information to third parties:

(a) in the event that we acquire or dispose of any business or assets, in which case we will disclose your personal information to the prospective transferor or transferee or such business or assets;

(b) if substantially all of our assets are acquired by a third party, personal information held by us may be one of the transferred assets;

(c) for auditing purposes;

(d) if we are under any legal or regulatory obligation to do so e.g. to comply with legal process or requests from government authorities;

(e) to permit us to pursue available remedies or limit the damages that we may sustain; and

(f) in connection with any legal proceedings or prospective legal proceedings, in order to establish, exercise or defend our or a third party’s legal rights.

Where your personal information is transferred, stored, and/or otherwise processed outside the UK or EU in a country which does not offer an equivalent standard of protection to the UK or EU, we will take all reasonable steps necessary to ensure that the recipient implements appropriate safeguards (such as relying on standard contractual clauses approved by the European Commission) designed to protect your personal information.

Studio BlueGreen takes appropriate technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We restrict access to those who have a need to know and we train staff in handling the information securely. Studio BlueGreen will store all the personal information you provide on secure servers. Unfortunately there is no such thing as perfect security in the online environment. As a result we cannot and do not guarantee the security of any information you transmit to us through or in connection with the website.

If you believe that your interaction with us is no longer secure (e.g. you consider that the security of any correspondence you might have with us has been compromised) please immediately notify us by contacting us at office@studiobluegreen.org.

We will keep your personal information for as long as necessary:

(a) To comply with any statutory or regulatory requirements we are subject to under applicable law;

(b) To fulfil the purposes for which the personal information was collected;

(c) To defend our or a third party’s legal rights.

Please note that where you unsubscribe from our email distribution list, we will keep a record of your details to ensure we do not send you marketing emails in future.

We will usually only retain your personal information for a maximum period of six (6) years after our last contact with you. However, if you have any questions about the retention periods for holding your personal information, please contact us using the details at section 15 below.

Please note that we will honour your requests to exercise your rights to the extent possible and required under applicable law. Certain of these rights may only be available to you if you are located in the UK or the EU when you access our website or otherwise engage with us.

You have the right to:

(a) Ask us for confirmation of what personal information we hold about you, and to request a copy of that information. If we are satisfied that you have a legal entitlement to see this personal information, and we are able to confirm your identity, we will provide you with this personal information.

(b) Withdraw your consent at any time if we have relied on consent as the lawful ground to use your personal information.

(c) Request that we delete the personal information we hold about you, as far as we are legally required to do so.

(d) Ask that we correct any personal information that we hold about you which you believe to be inaccurate.

Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. The Studio BlueGreen website utilises cookies for the purposes of managing our website and to understand and measure its performance. Studio BlueGreen may update this privacy notice by posting a new version on our website.
